The Tenth Circuit set oral arguments for September in litigation challenging President Joe Biden’s use of the Antiquities Act to re-establish Utah’s Bears Ears and Grand Staircase-Escalante national monuments.
In-person oral arguments in the case are scheduled for a yet-to-be determined date in September in Denver, according to a notice filed Thursday.
The court on Wednesday had scheduled oral arguments for May 15, but on Thursday vacated that date because some of the attorneys arguing the case said they’re not available. Arguments have been reset for a date between Sept. 23 and Sept. 27.
