Oil Lease Impact on Whales Unclear, Industry Tells 5th Cir. (1)

Industry groups told the Fifth Circuit on Monday that the changes that the Interior Department placed on the terms of the latest Gulf of Mexico oil and gas lease sale in order to protect the endangered Rice’s whale are debilitating.

Former US Solicitor General Paul D. Clement arguing for the industry groups, pointed to a supplemental environmental impact statement that the Bureau of Ocean Energy Management published in January that stated vessel strikes were “extremely unlikely” due to speeds, routes, and other mitigation measures for the whale’s “core area.”
