Ohio Files Preemptive Challenge to EPA Revisions of Ozone Rule

Ohio asked a federal appeals court Thursday to review additional guidance the Environmental Protection Agency published for the “Good Neighbor” ozone rule.

The state filed a protective petition for review in the D.C. Circuit after the agency updated its pollution rule to address issues raised by the US Supreme Court regarding how the plan worked with only a fraction of states still participating.
