Ohio Company, VP Plead Guilty to Selling Unregistered Virucide

Ohio-based DEM Technology LLC and Evan Morgan, its vice president, have pleaded guilty in federal court to selling an unregistered antimicrobial “fogger,” which they falsely claimed could sanitize an entire room, the Department of Justice announced Thursday.

The company received an authorization for SaniGuard as a surface spray in 1996, but it never established efficacy nor safety data associated with the product’s use as a fogger as required by the Federal Insecticide, Fungicide and Rodenticide Act, the department said.

The Environmental Protection Agency has issued correspondence to the corporation since 2004, which was acknowledged, and also entered a consent order ...
