No Proof Refinery Gas Flare Caused Injuries; Expert Witness Testimony Tossed After Trial

The first bellwether trial in litigation involving hundreds of Louisiana residents who allege an oil refinery’s brief discharge of a gas plume caused them to suffer various physical symptoms ended in the refinery owner’s favor Dec. 3 due to a lack of expert evidence (Shanley v. Chalmette Ref. LLC, E.D. La., 12-cv-3045).

Four plaintiffs went to trial in the suit, which involves 1,836 residents living near a Louisiana refinery owned by Chalmette Refining LLC. Residents alleged the refinery released approximately 595 pounds of hydrogen sulfide and 191,800 pounds of sulfur dioxide into the air in 2011.
