NL Industries Could Face Some Liability for Smelter Pollution

NL Industries can be held liable to clean up contamination from a lead smelter near Los Angeles under California law even though it’s not liable under federal law, a federal judge ruled.

California sued NL Industries and other companies under the Comprehensive Environmental Response, Compensation, and Liability Act and a similar state law. It alleged that they owned, operated, or sent hazardous waste to the smelter in Vernon, Calif., leading to more than $136 million in cleanup costs.
