The Ninth Circuit won’t temporarily pause a national youth climate lawsuit while the Justice Department works to get it dismissed.
The panel denied the Biden administration’s stay request in an order handed down on Thursday. The government is trying to quash Juliana v. US through a Feb. 2 writ of mandamus petition, which claims that a lower Oregon court was wrong to allow the case to proceed to trial.
