New York Petition on Smog Drift ‘Materially Deficient,’ EPA Says

New York failed to adequately support its petition asking the EPA to clamp down on pollution from about 350 industrial sources in nine upwind states, the agency said in a brief to a federal appeals court in the District of Columbia.

The state petitioned under the Clean Air Act’s “good neighbor” provision, which requires states to eliminate emissions significantly affecting air quality in a downwind state. After the Environmental Protection Agency decided not to act on the petition, New York, New Jersey, and New York City asked the U.S. Court of Appeals for the District of Columbia Circuit for review....
