New York Passes First-in-the-Nation Tax on Spent Nuclear Fuel

New York communities surrounding the soon-to-be decommissioned Indian Point nuclear power plant will be able to collect taxes on spent fuel, according to first-in-the nation legislation signed by Gov. Andrew Cuomo.

The measure (S.8075/A.10398) amends the tax law to include spent nuclear fuel pools and dry fuel cask storage systems as real property following the closure of the power station.

  • The law is the first of its kind in the nation, according to the Nuclear Energy Institute, a nuclear industry trade association. It was signed by Cuomo (D) late on Dec. 31 and took effect Jan. 1.
