New York Industry, Unions Given Last Chance in Gas Ban Lawsuit

Business groups and labor unions have more work to do to show that their challenge against a New York gas ban in new buildings should continue after a federal judge rejected their preemption argument.

The groups have standing to challenge New York’s natural gas ban but that ban isn’t preempted by federal law, Judge Glenn T. Suddaby of the US District Court for the Northern District of New York said Wednesday.

He denied the New York officials’ motion for judgment on the pleadings as well as the plaintiff groups’ motion for summary judgment and permanent injunction.
