A lawsuit from New Mexico Indigenous tribes and environmental activists alleging that the state failed to uphold its constitutional duty to control oil and gas pollution will move forward after a judge denied defendants’ request to throw it out.
The New Mexico First Judicial District Court determined that plaintiffs stated in their May 2023 lawsuit actionable claims that should be considered for relief, even if the court ultimately decides not to grant it, according to a Monday interlocutory order signed by Judge Matthew Wilson.
