New Jersey Says High Court Should Reject Pipeline Builder’s Case

New Jersey is calling on the U.S. Supreme Court to reject an energy company’s efforts to seize state-owned and managed land to build the $1 billion PennEast pipeline.

Garden State lawyers say a lower court got it right when it blocked PennEast Pipeline Co. LLC from taking state land for the project’s route. Though the developer has warned of dire consequences, New Jersey insists that “the sky has not fallen.”

“That PennEast can establish its right to file condemnation actions against private landowners does not simultaneously establish its right to sue the States,” Attorney General Gurbir S. Grewal wrote Tuesday, ...
