New Boiler Rule Must Be Vacated, Industry Groups Demand Again

The Department of Energy didn’t remedy industry concerns when adopting stricter commercial boiler efficiency rules, industry groups told the D.C. Circuit at oral argument Friday, asking the panel to again vacate the agency’s final rule.

“If the Department of Energy seriously considered the problems we raised, it would have come up with an entirely different analysis,” Jason Neal, representing the Air-Conditioning, Heating, and Refrigeration Institute, told a three-judge panel. “It’s not that DOE didn’t write enough about these issues, it’s that its analysis didn’t work.” Neal is an attorney at HWG LLP.
