Nebraska Court Blocks TransCanada Efforts to Acquire Land for Keystone Pipeline

A state court in Nebraska issued a temporary injunction Feb. 26 blocking TransCanada Corp. from exercising eminent domain to acquire land needed to construct the Keystone XL pipeline across the state (Dunavan v. TransCanada Keystone Pipeline LPinjunction).

The ruling by the Nebraska District Court, York County, was the second in two weeks by a Nebraska court against TransCanada, which began to initiate eminent domain proceedings against holdout landowners in the wake of a complex and contested ruling in January by the state Supreme Court that turned back a constitutional challenge to the state’s pipeline-siting law but that also ...
