New York officials want a federal court to dismiss the suit brought by business groups and labor unions challenging the state’s impending ban on gas appliances and infrastructure in new buildings.
The state officials told the US District Court for the Northern District of New York on Monday that the 11th Amendment bars the claims against most of the defendants.
The plaintiffs—including the New York State Builders Association and Transport Workers Union Local 101, AFL-CIO—sued the New York Department of State, its secretary, the state Fire Prevention and Building Code Council, and its members in October.
