New York Gov. Kathy Hochul vetoed legislation Thursday that sought to ban the use of hydraulic fracturing drilling fluids and brine on highways.
The measure (A.903/S.355) would have prohibited the fluids, brine and flowback water for purposes including de-icing and dust suppression. Hochul (D) said the bill as written would have “unintended consequences” and should be “based on a technical evaluation of the material rather than the source.”
She directed the state Department of Environmental Conservation to evaluate its current regulations on brine testing and decide whether further rules are necessary.
