A challenge to a nationwide permit issued for construction on parts of the Mountain Valley Pipeline project could be dismissed if a settlement is reached regarding attorneys’ fees between the federal government and environmental groups, the Fourth Circuit said.
The court’s statement comes after Mountain Valley Pipeline LLC applied for an individual permit and asked the U.S. Army Corps of Engineers to revoke its verifications for the project under Nationwide Permit 12. The Corps granted the requests March 2 and 3.
