Mountain Valley Can Continue Suit Against Pipeline Protesters

A group of ten protesters lost their second bid to get Mountain Valley Pipeline LLC’s claims dismissed over alleged interference with the company’s 300-mile-long natural gas pipeline.

The protesters argued that Mountain Valley’s statutory conspiracy claim fails to state a claim because the statute is “unconstitutionally vague.”

That argument was rejected in two similar cases, so “the issue was fully briefed and argued,” Judge Elizabeth K. Dillon of the US District Court for the Western District of Virginia said Tuesday.
