Monsanto to Face New Mexico PCB Nuisance Claims in State Court

Monsanto Co. will have to face in state court claims from New Mexico that it knew PCBs were contaminating natural resources and yet made contamination worse by instructing customers to dispose of the chemicals in landfills, a federal court ruled.

The company failed to show federal officer, federal enclave, or federal question jurisdiction in its notice of removal, according to the court ruling Thursday.
