Monsanto Faces Revived PCB Delaware Water Pollution Claims (1)

Monsanto Co. won’t get an early exit from a suit alleging it polluted Delaware’s waterways with polychlorinated biphenyls, the state high court ruled.

The state may pursue public nuisance claims and some trespass claims against Monsanto even though the company didn’t control the product after it was sold, the Delaware Supreme Court ruled Thursday in an opinion by Justice Collins J. Seitz Jr. The ruling upended a state trial court decision.
