Michigan Governor Urges Supreme Court to Hear Enbridge Lawsuit

Michigan Gov. Gretchen Whitmer (D) asked the US Supreme Court to hear her case against Enbridge Energy and its entities in the state’s effort to shut down the aging Line 5 oil and gas pipeline.

The US Court of Appeals for the Sixth Circuit ruled in April that the company could continue its litigation against Michigan officials to preserve the pipeline, saying Whitmer and the director of the state’s Department of Natural Resources don’t have immunity under the 11th Amendment—which prohibits individuals from suing state entities in federal court.
