Maryland Plans to Sue Mirant Over Leaks From Coal Ash Landfill Into Mataponi Creek

The Maryland Department of the Environment on Jan. 15 issued a notice of intent to sue Mirant Maryland Ash Management LLC for water pollution violations at the company’s Brandywine site, a landfill used to dispose of coal ash from a nearby power plant.

The department said Mirant is responsible for unpermitted discharges of toxic pollutants from the landfill, threatening Mataponi Creek and surrounding waters and violating both the Clean Water Act and Maryland law.

The department said it plans to file the lawsuit in the U.S. District Court for the District of Maryland March 17.
