Maryland Fails to Stop Natural Gas Pipeline Crossing State

Maryland lost its bid to prevent Columbia Gas Transmission LLC from acquiring land in the state for its natural gas pipeline spanning from Pennsylvania to West Virginia.

The US Court of Appeals for the Fourth Circuit said Wednesday that the district court was right to deny Maryland’s renewed motion to dismiss the case, based on a 2021 US Supreme Court ruling that the Eleventh Amendment doesn’t give states sovereign immunity from condemnation actions brought by properly authorized private parties.
