Maryland amended the state’s clean energy credit to extend the sunset date, set a minimum amount, and make the credit refundable in legislation (H.B. 464) Maryland Gov. Martin O’Malley (D) signed May 20.
The credit is available under Maryland Code Annotated Tax-General Section 10-720 for the production of electricity from qualified energy resources, which include:
- certain solid, nonhazardous, cellulosic waste material; and
- methane gas or other combustible gases resulting from the decomposition of organic materials from certain sources.
The credit is equal to 0.85 cents for each kilowatt hour of electricity produced during a five-year period.
