A trial in long-running Superfund litigation between Asarco LLC and Union Pacific Railroad Co. will begin Oct. 30, the District of Idaho ordered May 10 (Asarco LLC v. Union Pacific R.R. Co., D. Idaho, No. 12-cv-00283, trial date set 5/10/17).
Asarco contends Union Pacific is liable for at least $100 million in contribution costs stemming from an EPA-supervised cleanup along the Coeur d’Alene River watershed, where both companies had mining and smelting operations for a century.
