Legislature Puts Strict Limits on Wind Farms In Two Counties but Passes No State Rules

The Alabama Legislature stopped short of passing strict statewide regulations on wind turbines before adjourning for the year on April 3, but the state did enact local legislation that could kill approximately 100 megawatts from wind farm developments in two Alabama counties.

The local bills, S.B. 402 and S.B. 403, cleared the Legislature and were signed by Gov. Robert Bentley (R) on March 20.

The new laws establish permitting requirements for anyone seeking to install a wind turbine in Cherokee and Etowah counties, including a setback of 2,500 feet from the nearest property line and a maximum noise level ...
