The latest Gulf of Mexico oil and gas lease sale will be held without added protections for the endangered Rice’s whale after a federal appeals court said Tuesday that the intervening environmental groups challenging the sale lacked standing to sue.
The “chain of events” needed to show that oil and gas activities resulting from the lease sale without the protections could harm one of the whales and diminish recreational or aesthetic interests is “so attenuated” that the alleged harm isn’t “certainly impending,” the US Court of Appeals for the Fifth Circuit said.
