The Environmental Protection Agency failed to adequately consider the economic and energy reliability consequences of its final “Good Neighbor” regulations, according to amicus briefs filed Tuesday.
Republican lawmakers, the US Chamber of Commerce, and the American Exploration & Production Council told a panel at the US Court of Appeals for the District of Columbia Circuit that EPA’s rules that toughen requirements against traveling pollution are inherently flawed.
The agency’s “expansive” interpretation of air policy flies against the balance created by cooperative federalism, according to the friend of the court brief filed by lawmakers led by Sen.
