Lanxess Agrees to Drop Case Over EPA’s Chemical Test Order

A federal court has dismissed Lanxess AG‘s petition asking to challenge an EPA order after the agency clarified that Lanxess and certain other chemical manufacturers wouldn’t be required to test chemicals they formerly made.

The US Court of Appeals for the Third Circuit Sept. 16 dismissed Lanxess’ case challenging an order the EPA issued in March requiring it and 19 other manufacturers to carry out aquatic toxicity and consumer exposure tests for o-dichlorobenzene, which helps produce soaps, inks, and lubricants.
