Kroger Gets Settlement Bid in California ‘Forever Chemical’ Suit

A California resident is offering to drop claims that the Kroger Co. misled customers by saying food packaging containing “forever chemicals” could be composted.

Plaintiff David Ambrose, who lives in Irvine, Calif., said in a motion filed Thursday he will settle the case if Kroger stops saying in labels and ads that the goods are “100% compostable” or “compostable.”

Kroger couldn’t immediately be reached Friday for a comment. Judge Edward M. Chen of the U.S. District Court for the Northern District of California set an Aug. 12 deadline for a response, and a Sept. 2 hearing on the settlement.
