Keystone XL Ruling Should be Reversed, Army Corps Tells Court

The Army Corps of Engineers is calling on the Ninth Circuit to reverse a ruling that hamstrung the Keystone XL pipeline and could affect other projects.

  • The agency filed a brief Wednesday at the U.S. Court of Appeals for the Ninth Circuit, arguing that a Montana federal district court overstepped when it barred the use of a fast-track water permitting process called Nationwide Permit 12 for the TC Energy Corp. pipeline and other new oil and gas conduits.
