The Clean Air Act bars advocates from bringing a case challenging an emission rule exemption for chemical manufacturers, according to a Trump administration brief.
The Justice Department said the US District Court for the District of Columbia should dismiss the case brought by Texas Environmental Justice Advocacy Services, Air Alliance Houston, and other advocacy groups, which targets a presidential exemption for companies regulated under Hazardous Organic National Emission Standards for Hazardous Air Pollutants, also known as the HON Rule.
Advocates say the exemptions exceed presidential authority and will allow for more pollution to be released in vulnerable communities.
