The Justice Department on Aug. 16 filed a Clean Air Act lawsuit against Luminant Generation Co., alleging that Texas’s largest power generator modified two power plants without obtaining appropriate permits (United States v. Luminant Generation Co. LLC, N.D. Texas, No. 13-cv-03236).
DOJ filed the lawsuit under seal in the U.S. District Court for the Northern District of Texas, alleging Luminant violated new source review and prevention of significant deterioration provisions of the Clean Air Act when it modified the Big Brown and Martin Lake generating plants in East Texas.
