Judges Question EPA Decision to List Toxic N.J. Superfund Site

D.C. Circuit judges were skeptical Wednesday that the EPA fully explained its rationale for placing a mercury-contaminated New Jersey creek on its toxic cleanups list.

Troy Chemical Corp. Inc., one of the parties potentially responsible for cleanup at the site, argued against the Environmental Protection Agency’s decision before the U.S. Court of Appeals for the District of Columbia Circuit. The agency overestimated the potential for humans to be harmed by eating mercury-contaminated fish downstream of the site, the company said.
