Judge Partially Grants EPA Bid to Reopen Denka Endangerment Case

A federal district judge on Tuesday partially granted an EPA request to reopen a case aimed at mitigating carcinogenic emissions from a Louisiana synthetic rubber plant.

Judge Carl J. Barbier of the US District Court for the Eastern District of Louisiana ordered that EPA’s legal quest to initiate a rarely-used shutdown order be restarted, and that parties must meet for status conference on next steps in November.

Barbier wants parties to discuss whether the case will see renewed briefing and limited discovery, as well as how similar cases against Denka Performance Elastomer LLC would affect this action.
