An insurance company is on the hook to indemnify a chemical manufacturer for all defense and settlement costs from a lawsuit for the wrongful death of an employee, a Utah court held April 5 (One Beacon American Insurance Co. v. Huntsman Polymers Corp., Utah Ct. App., No. 20100327-CA).
The Utah Court of Appeals, in an opinion by Judge Stephen L. Roth, held that Texas law applies to the dispute between the insurer and the policyholder because Texas had a more significant relationship to this dispute than Utah.
