MUMBAI—The Madras High Court of the state of Tamil Nadu, India’s largest wind power producer, has ruled that wind turbines fit the definition of “factory” under state law and, therefore, require permission from local governments prior to installation.
Previously, project developers needed only the permission of the owner of land where the windmill was to be installed. Developers often purchase their own land for wind farms.
The court also ruled on the distance to be maintained between a new windmill and other lands or immovable properties.
