Idaho Fails to Push Administrative Claims Against Forest Service

Idaho lost its bid to bring cross claims against the US Forest Service and its officials for restricting the use of aircraft landings at a designated wilderness area.

“Without a clear, mandatory duty that the Forest Service is required to perform,” the court doesn’t have jurisdiction over Idaho’s Administrative Procedure Act claims, Magistrate Judge Candy W. Dale of the US District Court for the District of Idaho said on Tuesday.
