A pension fund covering coal mine workers lost its bid for US Supreme Court review of a decision allowing Energy West Mining Co. to avoid a $115 million bill after withdrawing from the fund.
The justices on Monday declined to review a decision invalidating how the United Mine Workers of America 1974 Pension Plan calculated Energy West’s withdrawal liability. The fund argued that this decision conflicted with Supreme Court precedent and decisions by other appeals courts while sowing confusion about the “most important assumption” actuaries must make in calculating this liability.
