Green Groups Appeal Decision Gutting Environmental Permit Rule

Environmental groups appealed a federal judge’s February ruling that the White House Council on Environmental Quality can’t enforce permitting regulations from the Biden administration because it lacks authority to issue rules in the first place.

The notice of appeal—filed Monday by intervenors Food & Water Watch, the National Wildlife Federation, and 15 other organizations—sends a 2024 case over the council’s authority to the US Court of Appeals for the Eighth Circuit.
