Green Group Targets Coal Ash After Supreme Court Water Ruling

Environmental groups are calling on a federal court to resolve a coal ash pollution appeal in their favor in light of the Supreme Court’s recent Clean Water Act ruling.

The Prairie Rivers Network on Thursday urged the U.S. Court of Appeals for the Seventh Circuit to revive the group’s claims that discharges from a retired coal-fired power plant in Illinois violate federal law.

In a preview of what’s likely to become a common dispute, power plant operator Dynegy Midwest Generation countered that the Supreme Court precedent doesn’t make the company liable under the Clean Water Act.
