An environmental group failed to revive a lawsuit against a restaurateur over a “low break” Fourth of July firework explosion over the Los Angeles Bay after a federal appeals panel reaffirmed its earlier ruling that the company’s Clean Water Act violation won’t likely happen again.
The US Court of Appeals for the Ninth Circuit issued a revised opinion and denied the California Environmental Rights Foundation’s petition for rehearing Wednesday after additional discovery in a lower court established the Naples Restaurant Group has continued to pay the annual fee for its National Pollutant Discharge Elimination System permit.
