Georgia Dock Project Gets Eleventh Circuit Nod in Second Appeal

The US Army Corps of Engineers need not conduct a full environmental review of a private dock project on the Georgia coast because the construction won’t impact a federal waterway, a federal appeals panel ruled Monday.

The Army Corps was “within bounds to characterize the project as ‘minor,’” and reasonably issued a letter of permission in place of a full-fledged project permit under several statutes, including the National Environmental Policy Act and the Administrative Procedure Act, the US Court of Appeals for the Eleventh Circuit said in an unpublished opinion.
