New York state’s new ban on gas equipment and infrastructure is preempted by federal law and therefore unenforceable, a coalition of business groups and labor unions said in a lawsuit filed in federal court on Thursday.
Gov. Kathy Hochul (D) signed the All-Electric Building Act into law in May as part of her fiscal 2024 state budget. The law requires nearly all new buildings to be all-electric, starting in 2026 for small buildings and 2029 for bigger ones.
