Forest Service Sued For Polluting Waterways with Fire Retardant

Fire-retardant chemicals sprayed by US Forest Service aircraft are leaking into, and polluting, American waterways in violation of the federal Clean Water Act, a nonprofit organization alleged in a complaint filed in federal court in Montana.

Between 2012 and 2019, the Forest Service discharged 761,282 gallons of retardant pollutant directly into national forest navigable waters, according to the Forest Service Employees for Environmental Ethics complaint filed on Tuesday at the US District Court for the District of Montana at Missoula.

The Forest Service failed to get a National Pollution Discharge Elimination System permit, the nonprofit group also said.
