The EPA has finalized fast-tracked guidance clarifying Clean Water Act permitting requirements for indirect pollution, the agency announced Tuesday.
In just over a month’s time, the Environmental Protection Agency proposed and finalized the guidance, drawing swift criticism from both industry and environmental lawyers. The guidance, which was issued in draft form on Dec. 8, is scheduled to be published in Wednesday’s Federal Register.
It’s unclear how President-elect Joe Biden’s administration will approach the new guidance, but its critics say it will consider tossing it out.
