Fractured Fifth Circuit Panel Affirms Exxon $19 Million Fine (2)

Exxon Mobil Corp. is still on the hook for millions of dollars in damages for excess pollution, according to a decision from a sharply divided en banc Fifth Circuit panel Wednesday.

“Justice delayed is justice denied,” according to the per curiam decision to affirm the lower court’s 2017 judgment.

“Had we known that it would take a year and a half after en banc oral argument to issue an opinion, we would not have granted en banc rehearing,” judges said in the per curiam order.
