The Fifth Circuit tossed a nuclear waste storage case concerning a facility in New Mexico, following the US Supreme Court’s instructions in a different lawsuit.
“Applying the Supreme Court’s holding in NRC v. Texas, we lack jurisdiction to consider this petition,” the US Court of Appeals for the Fifth Circuit said in its short unpublished opinion Monday.
