An association of municipal utilities failed to make timely arguments against the Federal Energy Regulatory Commission’s approval of an upgrade to an interstate natural gas transportation system, the agency told the DC Circuit.
FERC’s order was based on “an administrative record that fully supports all of the Commission’s determinations,” said the brief filed in the US Court of Appeals for the DC Circuit on Aug. 15.
The East Tennessee Group claimed in June that FERC made the wrong decision when approving a pipeline company’s requested method for allocating costs for its project.
