FERC Bankruptcy Fight Over PG&E Contracts Dismissed by 9th Cir.

The Federal Energy Regulatory Commission can no longer fight with a bankruptcy court over who has the power to decide whether Pacific Gas & Electric Co. can stop performing under its wholesale power contracts, the Ninth Circuit said.

The U.S. Court of Appeals for the Ninth Circuit declined to rule on the merits of the dispute, saying the cases became moot when the bankruptcy court approved a reorganization plan that required PG&E to assume the contracts at issue.

The appeals court then vacated related agency and lower court orders.
